Donation Terms and Conditions
Version 1.4
The Portuguese text of this document is canonical; this English version is a translation provided for convenience.
1. Purpose
This document explains, in plain terms, how donations reach the Fundação Terra Agora (“the Foundation”), what we are legally required to collect from donors above certain amounts, and what happens when that information is not provided. It applies to every donation channel the Foundation uses.
2. How to donate
The Foundation currently accepts donations through:
- Donorbox, for card, PayPal, Apple Pay, Google Pay, MB WAY, Multibanco and recurring donations, on the Foundation’s donation pages;
- Bank transfer, to the Foundation’s account at Caixa Geral de Depósitos.
Further channels will be added here as they become available.
Fees and processing details for each channel are set by the respective provider and are not covered by this document.
By donating to the Foundation through any of these channels, including by bank transfer, the donor confirms acceptance of this document and of the Foundation’s Privacy Policy, published at terra-agora.org/privacy-policy/.
3. Identification we are required to collect
Under the Portuguese law governing the activity of foundations (Lei n.º 83/2017), the Foundation must identify donors above a certain amount before it may accept and keep their donation.
- Below €100: no identification is required.
- €100 or more: the Foundation must hold the donor’s full name, nationality, date of birth, identity document details (type, number, validity and issuing authority), residential address, tax identification number and a contact, in addition to the amount and date of the gift (Article 146.º, n.º 1, alínea e), Lei n.º 83/2017). This threshold is assessed over twelve months, not gift by gift: a recurring donation, such as a monthly pledge, is counted by what it adds up to over a year, so a monthly gift that totals more than €100 a year is covered even though no single instalment reaches €100 on its own, while a monthly gift that stays under €100 a year is not.
Where a donation channel does not itself capture this information, for example a bank transfer, or where the donor leaves an optional field blank on a donation form, the Foundation will ask for it directly by email after the donation is made.
4. How we verify this information
If a donation reaches the Foundation without all of the details listed above, for example because a donor’s Donorbox form left an optional field blank, or because a bank transfer did not include them, the donor will receive a follow-up email from verificacao@terra-agora.org asking for the missing information. This is a routine part of how the Foundation complies with the law, not a sign that anything is wrong with the donation. Replying promptly allows the Foundation to issue a receipt without delay.
For some donations the Foundation may also ask supporting questions, or for a copy of an identification document, as part of its own donor due diligence procedure, which goes beyond what the law strictly requires. This is handled case by case and is not tied to a fixed amount published here.
5. If the information is not provided
A donation of €100 or more that is not accompanied by the required identification cannot lawfully be accepted or kept by the Foundation. If a donor does not respond to the Foundation’s request for this information within a reasonable time, the donation will be returned to the donor by the same means it was received, and no receipt will be issued for it.
Donations below €100 are never affected by this condition.
6. How your information is used
Information collected under this policy is used only to meet the Foundation’s legal identification duties, to issue receipts, and for the Foundation’s own record keeping. It is handled in accordance with the Foundation’s Privacy Policy, published at terra-agora.org/privacy-policy/, and is not shared except as the law requires.
7. Tax treatment
The Foundation does not currently hold the status of utilidade pública and has not yet obtained the Mecenato Ambiental declaration provided for in Article 62.º of the Estatuto dos Benefícios Fiscais. Until that declaration is granted, no donation to the Foundation carries a tax benefit, and nothing in this document should be read as implying one.
8. Questions
Any question about a donation, or about the information requested above, can be sent to donativos@terra-agora.org. A request already under review by verificacao@terra-agora.org can also be answered directly to that address. We welcome hearing from our donors at any time.
9. Status of this document
This is version 1.4. The €100 identification threshold is confirmed (Article 146.º, n.º 1, alínea e), Lei n.º 83/2017), as is the list of data to be collected from that amount and the twelve-month basis on which recurring gifts are counted towards it. Whether, and above what further amount, the Foundation will also ask for a copy of the donor’s identification document is still under review with legal counsel and is deliberately not fixed here; it is applied internally on a case by case basis in the meantime.
Version 1.4 adds an express acceptance clause to Section 2, stating that donating through any channel, including bank transfer, constitutes acceptance of this document and of the Foundation’s Privacy Policy.
