Context and commitment

The Terra Agora Foundation is a Portuguese private-law foundation, recognised by the Portuguese State, dedicated to land protection, ecological regeneration and the care of the land. The trust of the people, communities, donors and institutions we work with is essential to our mission.
This Privacy Policy clearly explains how we collect, use, protect and respect the personal data of individuals who interact with the Foundation, in accordance with the General Data Protection Regulation (“GDPR”) and Law No. 58/2019 of 8 August, as well as other legislation relating to the protection of personal data and privacy.

The FTA undertakes to:

2. Purposes of the processing

iii. Administrative and accounting management
The processing of personal data may be necessary for the processing of donations and the issuing of the relevant receipts.

iv. Record of participation in initiatives, events and training
Data processing may be necessary to manage the registration and organisation of initiatives, events and training activities, as well as to issue certificates, where applicable.

v. Production of institutional materials
The FTA may produce institutional materials which may include the use of your image and voice.

vii. Partner management
The FTA establishes partnerships with certain institutions and individuals, within the framework of which it processes personal data strictly necessary for the management, monitoring and development of these partnerships.
The legal basis for this processing is the performance of pre-contractual measures or the performance of contracts. The data are retained for as long as the partnership relationship continues.

viii. Statistical and analytical purposes
Personal data may be processed for statistical and analytical purposes, with a view to evaluating and improving the activities, projects and initiatives of FTA.

ix. Historical archive
The processing of personal data in this context is intended to preserve the organisation’s institutional memory, document the activities of the FTA and promote its historical heritage.

3. Categories of Personal Data

In the context of the stated purposes, the FTA processes only the data strictly necessary to fulfil those purposes; it therefore collects the following categories of personal data:

• Personal details: name, email address, date of birth, Citizen Card number or other form of identification (e.g. passport, residence permit);
• Contact details: address, telephone number;
• Billing details: tax identification number, address;
• Other details: occupation, financial situation, appearance, voice.

Without prejudice to the consent to be obtained at a later date for each purpose, FTA may use your image and voice data for:

• Publication on digital channels (website, social media, newsletters);
• Presentation of institutional materials (reports, leaflets, posters, presentations);
• Exhibitions, public events and educational activities;
• The Foundation’s historical archive.

4. Data transfers

In certain cases, FTA may disclose your personal data, to the extent strictly necessary, to third parties providing services (“data processors”) for the purposes set out above and in accordance with the contractual obligations and instructions agreed with them; these may include:

• Service providers (e.g. web hosting, email marketing, payment systems, analytics);
• Digital platforms (e.g. social media, websites);
• Institutional partners;
• Legal, tax or IT advisers.

Data may be disclosed to authorities or third parties where such disclosure is made in order to comply with a legal and/or contractual obligation, at the request of the CNPD (www.cnpd.pt) or another relevant authority, and/or pursuant to a court order.

The FTA has implemented appropriate technical and organisational measures, in line with national and international best practice, to protect your personal data. These include technological, administrative, technical and physical measures, as well as procedures designed to ensure the protection of your personal data and to prevent its misuse, unauthorised access, disclosure, loss, unauthorised or inadvertent alteration, or destruction, including:

• Access control;
• Internal security policies;
• Protection against loss and unauthorised access;
• Regular audits and assessments.

6. Rights of the Data Subject

Under the terms of the applicable legislation, and as the data subject, you may at any time exercise the right to:

• Access personal data;
• Request the rectification or updating of personal data;
• Request that it be deleted, where legally applicable;
• Limit treatment;
• Portability;
• To object to the processing;
• Withdraw consent, without prejudice to the lawfulness of processing
carried out on the basis of consent previously given;
• Lodge a complaint with the competent supervisory authority, the
National Data Protection Commission (“CNPD”)– www.cnpd.pt).
